MEMORANDUM

TO:  Board of Directors and Community Members Tradd’s Landing Homeowners Association

FROM: Attorney David Langley, Association Counsel

RE: GT Homes Proposed Development – Responses to Community Questions

 

 

The Board has received several questions from residents concerning the proposed GT Homes development, potential access through or adjacent to Tradd’s Landing, and the developer’s verbal proposal to the Association. The purpose of this memorandum is to provide the information known to the Association and to identify those questions that require additional information from GT Homes, its counsel, or other professionals.

 

This memorandum is intended to assist the Board in providing residents with accurate information before the upcoming Board meeting. Certain aspects of the proposed development remain subject to negotiation, governmental review, and further information from developer. Accordingly, some questions cannot presently be answered definitively but are addressed in the answer.

1. Will the entire community vote on an agreement with GT Homes?

Yes. The anticipated proposal is not simply a payment or gift from GT Homes to the Association. Based upon the discussions to date, GT Homes is seeking an agreement from the Association addressing or releasing potential Association claims concerning access over Lot 22. It is assumed that GT Homes seeks resolution of this issue in connection with obtaining financing and further development of the larger tracts of property they own.

 

Because the contemplated transaction involves Association property rights my recommendation is that any final agreement with GT Homes be submitted to the Association membership for approval rather than approval solely by the Board of Directors. The precise voting procedure, required approval threshold, and form of the proposed agreement will need to be determined after the Association receives any actual agreement from GT Homes. It will then be reviewed considering the Association’s governing documents and applicable Florida law. Any formal membership vote would be conducted in accordance with the Association’s governing documents and applicable Florida law.

2.  If GT Homes pays money to the Association, how would that money be used?

No allocation has been determined to date. The Board has not committed Association funds to any particular project or expenditure at this time. Allocation of funds would likely only occur after community input or after a community vote, depending on the details of any agreement with GT Homes.

3. Who would be responsible for future road maintenance and increased wear caused by additional traffic?

Lake County Public Works is responsible for maintenance of Harvest Boulevard and all roads within the Association since they are publicly dedicated and maintained right of way.

4. What effect will the development have on Tradd’s Landing property values?

It cannot be reliably determined or predicted how this development, as well as the larger Panther Run community, will increase, decrease, or have no material effect on property values within Tradd’s Landing. Property values depend on numerous market and property specific factors.

5. Will residents be able to review the development plans, zoning materials, traffic studies, and similar documents?

Yes, Materials submitted to Lake County in connection with development approvals are generally available as public records. The Association may also request relevant plans and supporting materials directly from GT Homes. The Panther Run community plans that were recently approved by the Lake County Board of County Commissioners are publicly available, but do not appear to border Tradd’s Landing.

6. Can GT Homes or Panther Run obtain pedestrian or golf-cart access through the pool/parking area? What happens to the parking lot and amenities?

No. For either entity to be able to do so, an agreement with Tradd’s Landing would have to be reached which would legally permit GT Homes, Panther Run, or residents of another development to use the Tradd’s Landing pool area, parking area, playground, or other Association controlled property for access or amenities. Any proposal involving those areas would require the Association’s permission and would likely be put to a vote of the membership as part of any type of agreement reached with GT Homes.


  1. Does Tradd’s Landing have a choice concerning access of Lot 22

Yes. However, the situation is more nuanced than just simply stating that Tradd’s Landing either has complete control over access or has “no choice.”


The Association could decline to enter into any voluntary agreement with GT Homes and could decline to voluntarily release whatever rights or claims it may have concerning Lot 22 and access. GT Homes therefore does need the Association’s voluntary cooperation via an agreement if it wants to resolve those issues without being forced to take legal action.


However, declining an agreement would not necessarily prevent GT Homes from pursuing access. GT Homes could instead seek judicial relief against the Association. While it is impossible to predict exactly how litigation would resolve, there is significant risk that GT Homes would ultimately prevail in litigation concerning access. Litigation would also expose both sides to substantial expense and could take many months or longer to resolve. The ultimate result, including responsibility for attorneys’ fees, costs, or compensation, cannot be guaranteed.

 

Accordingly, the issue presented to the community is not simply whether residents “want” or “do not want” the development to have access. The practical question is whether a negotiated resolution provides sufficient value and protections to Tradd’s Landing when compared to the potential costs, risks, delay, and uncertainty associated with litigation.

8.  Why shouldn’t the Association simply make a decision immediately?

There is presently no need for the Association to make a decision or take any action. GT Homes has its own development, financing, and governmental approval timelines. By contrast, the Association can simply wait and maintain the status quo unless the community’s desire is to accept the cash offer previously made by GT Homes and grant access over Lot 22. The Panther Run community approved by the Lake County Board of County Commissioners on September 1, 2026, does not include the property bordering Tradd’s Landing (Alternate Key #1031435) and it is possible that GT Homes has moved on from including this portion of the property in their current development plans due to the access issue concerning Lot 22.

 

9.  What questions remain unanswered?

Several resident questions concern matters that cannot presently be answered because the information that would answer those questions is primarily within the knowledge or control of GT Homes, its engineers, and consultants. These include:

 

a)     The anticipated traffic volume and traffic impacts;

b)    The location and design of proposed entrances and whether a traffic signal or additional entrance will be required;

c)     The availability or feasibility of alternative access routes;

d)    The precise location of the proposed connection to Tradd’s Landing;

e)     The distance between proposed improvements/new homes and existing Tradd’s Landing homes;

f)     The anticipated construction start date and overall construction schedule;

g)    Development phasing;

h)    Permissible construction hours;

i)      Whether homes adjoining Tradd’s Landing will be one or two story;

j)      Proposed noise, buffering, landscaping, and safety measures;

k)    The final development plan and governmental conditions or approval.

 

These are legitimate community questions, but the Board should avoid speculating about matters that have not yet been confirmed. The Association can continue requesting this information from GT Homes and reviewing materials filed with Lake County as they become available.

Conclusion

At this stage, no written agreement has been offered by GT Homes, and the community has not surrendered any rights. GT Homes has not officially communicated with the Board since the community meeting was held on May 18, 2026. If desired, the Association can engage in negotiating with GT Homes, request additional information and concessions, and evaluate the developer’s proposal before presenting any final agreement to the membership, if an agreement is still sought by GT Homes.

 

The Board’s immediate objective should be to obtain the remaining information, identify the improvements and compensation that would provide meaningful value to Tradd’s Landing, as is their fiduciary responsibility, and determine whether a negotiated resolution is preferable to the expense and uncertainty associated with litigation.

Very interesting report. What interests me most is, can we afford the cost of litigation? I suggest we wait for official filings with GT homes, then we take up issues that pertain to Tradd’s.
